This is an appeal by the Director of the Department of Motor Vehicles (hereinafter DMV) from a judgment of the superior court in administrative mandamus setting aside a decision of DMV to revoke, for a period of six months, the drivers license of Donald McConville (McConville). The license revocation was based on McConvilles asserted failure to comply with the provisions of Vehicle Code section 13353, which creates, on the part of drivers suspected of being intoxicated, an implied consent to a chemical test of either their blood, breath, or urine.
